Liability Waiver & Release of Claims

1. Acknowledgement of Risks and Voluntary Participation

1.1 The Participant acknowledges that the Event involves high-intensity treadmill sprinting and understands that participation in the Apex Titan 1 500-meter sprint challenge carries inherent, foreseeable, and unforeseeable risks of personal injury. Such risks include, without limitation, falls, sprains, muscle strains, joint injuries, cardiovascular or respiratory distress, fainting, fractures, bruises, abrasions, and injuries resulting from equipment malfunction. The Participant further acknowledges additional risks associated with a public event environment, including crowd congestion, physical collisions, waiting lines, and slippery or uneven surfaces.

1.2 The Participant represents and warrants that they are in good physical condition and do not suffer from any medical condition that would render participation unsafe, including but not limited to cardiovascular disease, hypertension, asthma, musculoskeletal disorders, pregnancy, or post-operative recovery. If the Participant has any pre-existing conditions, injuries, or allergies that may affect participation, they voluntarily agree not to participate. The Participant assumes full responsibility for any consequences arising from failure to disclose relevant medical information.

1.3 Participation is entirely voluntary. No purchase is required to participate. The Participant retains the right to withdraw from the Event at any time, decline treadmill participation, or forfeit eligibility for any prize or giveaway. The Organizer shall not compel participation under any circumstances.

2. Release of Liability and Waiver of Claims

2.1 The Participant hereby voluntarily, permanently, and irrevocably releases, waives, and discharges any and all claims, demands, causes of action, lawsuits, arbitration claims, and rights to compensation against the Organizer, brand owner, event agencies, store employees, venue operators, equipment suppliers, media partners, and each of their respective parent companies, subsidiaries, officers, employees, agents, successors, and affiliates (collectively, the “Released Parties”).

2.2 The Participant agrees that, regardless of cause—including negligence of the Released Parties, normal wear and tear of equipment, operational or supervisory oversight, third-party conduct, Participant error, or sudden medical conditions—the Participant shall not seek or claim any form of compensation, including but not limited to medical expenses, loss of income, emotional distress, disability compensation, litigation costs, or attorney’s fees.

2.3 If the Participant’s injury or property damage results in third-party claims, insurance reimbursement actions, or claims by family members, the Participant shall bear full and exclusive legal and financial responsibility. In the event that such claims cause loss, liability, or litigation against the Released Parties, the Participant agrees to fully indemnify and hold harmless the Released Parties for all resulting damages, including attorney’s fees, court costs, preservation expenses, and settlement costs.

3. Event Rules and Data Authorization

3.1 The Participant agrees to strictly comply with all staff instructions, treadmill operating procedures, and publicly announced event rules. Any violation, including unsafe operation, malicious conduct, disruption of order, or cheating or falsification of results, may result in immediate disqualification from competition, prize eligibility, and leaderboard ranking. Any previously received non-grand prizes shall not be reclaimed; however, all future prize eligibility shall be forfeited. If the Participant causes equipment or property damage, they shall be fully liable for all resulting losses.

3.2 The Participant authorizes the Organizer to collect and use their provided email address solely for prize notifications, event confirmations, and promotional pre-sale communications. The Organizer shall not sell, rent, or disclose the Participant’s personal email information to any third party. Upon request after the Event, the Participant may request deletion of their submitted personal data.

3.3 Photographs of treadmill score screens taken by staff shall be used solely for result verification, fraud prevention, and internal recordkeeping purposes. Such materials will not be publicly disclosed. The Participant raises no objection to such use.

4. Social Media Participation Terms

4.1 Participation in daily ranking selections and consolation prize eligibility requires the Participant to publish content on a public social media account. Private, hidden, or fraudulent accounts are not eligible. The Participant agrees that posted content shall not contain infringing, violent, or unlawful material. Any disputes related to the Participant’s social media accounts shall be the Participant’s sole responsibility.

4.2 The Organizer is granted the right to use photos taken at the event and Participant-generated social media content for promotional purposes, limited to store-level and official social media channels. No additional commercial compensation shall be provided. The Participant voluntarily waives any rights or claims relating to image, likeness, or publicity rights arising from such usage.

5. Age and Legal Capacity Representation

5.1 The Participant confirms that they are at least 18 years of age and possess full legal capacity. Individuals under 18 are strictly prohibited from participating in the competition or prize activities. Staff reserve the right to refuse participation, data submission, or prize eligibility to any minor.

5.2 If the Participant provides false age information or uses another person’s email/account to participate, all participation and prize eligibility shall be immediately voided. Any resulting injury or damages shall be the sole responsibility of the misrepresenting individual and their legal guardian, where applicable.

6. Additional Prize and Giveaway Terms & Disclaimers

6.1 On-Site Treadmill Grand Prize Time-Limited Rules
The on-site treadmill giveaway is strictly limited to July 1, 4:00 PM–7:00 PM, divided into three hourly sessions. Each hour releases 15 treadmills, totaling 45 units. Each session includes Top 5 performance awards (5 units) and random lucky draw awards (10 units). Top 5 winners are excluded from the random draw for that same hour. No on-site treadmill giveaway will be conducted from July 2 to July 12. All additional treadmill giveaways will be conducted exclusively via official social media channels.

6.2 Winning Restrictions and Disqualification Rules
Each Participant is eligible to win only one treadmill prize throughout the entire Event. Once a prize is awarded, the Participant will be excluded from all subsequent rankings and random draws. For multiple attempts within the same hour, only the best valid result will be recorded. Cross-hour participation is permitted but remains subject to the one-prize-per-person limitation. Any fraudulent behavior, cheating, or manipulation of results shall result in immediate disqualification.

6.3 Prize Fulfillment, Warranty, and Forfeiture Terms
All on-site gifts are non-returnable and non-exchangeable. Treadmill prizes are covered only by standard manufacturer warranty. Participation in the Event does not constitute a commercial purchase contract. All prizes will be shipped; no on-site pickup is available. Failure to provide accurate shipping information within the required timeframe shall be deemed voluntary forfeiture of the prize. Prizes are non-exchangeable, non-transferable, and cannot be redeemed for cash.

6.4 Online Social Media Giveaway Supplemental Terms
Online giveaway rules shall be subject to official social media announcements. The one-prize-per-person rule applies to online giveaways as well. The Organizer shall not be responsible for re-issuing prizes in cases where redemption fails due to platform restrictions, account issues, or inability to contact the winner.

7. Governing Law and Dispute Resolution

7.1 This Agreement shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law principles.

7.2 Any dispute arising out of or in connection with this Event or this Agreement shall be submitted to the exclusive jurisdiction of the courts located in the county where the Texas store is situated. The Participant voluntarily waives any right to initiate litigation in another jurisdiction or participate in any class action proceeding.

8. Acknowledgement and Legal Effect

By checking “I Agree to the Safety Waiver & Release of Claims” and submitting their email, the Participant acknowledges that this electronic acceptance has the same legal effect as a handwritten signature. The Participant confirms that they have fully read and understood all terms, had sufficient time to review them, and voluntarily agrees to be bound without objection.
