Liability Waiver & Release of Claims

1. Acknowledgment of Risks and Voluntary Participation

1.1 The participant acknowledges that this Event involves high-intensity treadmill racing and fully understands that using the Apex Titan 1 treadmill and participating in a 500-meter sprint carries inherent, foreseeable, and unforeseeable personal risks, including but not limited to: falls, sprains, muscle strains, joint injuries, cardiopulmonary discomfort, fainting, fractures, bruises, abrasions, and bodily harm caused by equipment malfunction. Additionally, there are supplementary safety risks such as crowd congestion, collisions, queuing, and slippery floors.

1.2 The participant warrants that they are in good physical health and have no medical conditions that would make high-intensity racing unsuitable, such as heart disease, hypertension, asthma, bone or joint disorders, pregnancy, or post-surgical recovery. If the participant has any pre-existing conditions, sports injuries, or allergies, they voluntarily choose to participate at their own risk. Any consequences arising from concealing health conditions shall be borne solely by the participant.

1.3 Participation is entirely voluntary. The Event is free of charge. The participant has the full right to terminate participation, decline to use the treadmill, or forfeit lottery eligibility at any time. The Organizer will not compel any participation.

2. Liability Release and Waiver of Claims

2.1 The participant voluntarily, permanently, and irrevocably waives, releases, and discharges the Organizer, brand partners, event execution agencies, store staff, venue property management, equipment suppliers, cooperating media, and their respective parent companies, subsidiaries, employees, agents, successors, and affiliates (collectively referred to as the “Released Parties”) from any and all claims, lawsuits, arbitrations, or demands for compensation.

2.2 Regardless of the cause — including but not limited to negligence of the Released Parties, normal equipment wear and tear, on-site management oversights, third-party collisions, participant’s own operational errors, or sudden medical conditions — the participant agrees not to seek any compensation from the Released Parties for medical expenses, lost wages, emotional distress damages, disability compensation, litigation costs, attorney fees, or any other form of compensation.

2.3 If the participant’s injury or property damage results in any third-party claims, medical insurance subrogation, or claims from family members, the participant shall independently bear all legal and financial liabilities in full. If this causes any loss or litigation to the Released Parties, the participant shall fully indemnify the Released Parties for all losses incurred, including attorney fees, litigation costs, preservation fees, and settlement expenses.

3. Event Rules and Data Authorization

3.1 The participant agrees to strictly follow all instructions from on-site staff, treadmill operating procedures, and publicly posted event rules. In cases of rule violations, malicious racing, disruption of order, or cheating/tampering with results, the Organizer reserves the right to immediately disqualify the participant from the competition, lottery, and leaderboard awards. Any prizes already received will not be reclaimed, but all winning opportunities will be forfeited.

3.2 The participant authorizes the Organizer to collect the provided email address solely for the purposes of prize notification, event confirmation emails, and pre-sale promotional information. The Organizer promises not to sell or lend the participant’s email address to any third party. After the event ends, the participant may request deletion of their personal data.

3.3 Photographs of the treadmill results screen taken by staff are used solely for result verification, anti-cheating reconciliation, and record-keeping purposes and will not be publicly disseminated. The participant has no objection to this.

4. Social Media Participation Agreement

4.1 To participate in the Race to Win (Game A), the participant must post publicly on their social media account. Private accounts, hidden accounts, or fake accounts are not eligible for awards. The participant warrants that their posts will not contain infringing, violent, or illegal content. Any disputes related to social media accounts shall be handled by the participant themselves.

4.2 The Organizer has the right to use on-site photographs and the participant’s social media posts for event promotion, including store and official social media channels only, with no additional commercial payment. The participant voluntarily waives any right to claim compensation related to portrait/image rights.

5. Age and Legal Capacity Commitment

5.1 The participant confirms that they are at least 18 years old and possess full civil legal capacity. Persons under 18 are prohibited from participating in the racing and lottery activities. Staff have the right to refuse minors from using the treadmill, submitting information, or entering the lottery.

5.2 If the participant misrepresents their age or uses another person’s email/account to participate, all competition and prize qualifications will be automatically invalidated. Any resulting personal injury shall be the full responsibility of the person who misrepresented their age and their legal guardian.

6. Lottery and Prize Rules – Additional Disclaimer

6.1 The on-site ball-draw lottery and daily leaderboard treadmill grand prizes are random or ranking-based benefits. The Organizer does not guarantee that every participant will win a major prize. If the treadmill grand prize is not drawn on a given day, it will roll over according to the rules. The event rules have been publicly displayed on-site, and the participant has no objection.

6.2 There is no after-sales return or exchange service for mailed prizes or on-site merchandise. Treadmill prizes are covered only by the manufacturer’s standard warranty. Participation in the event does not constitute a sales contract. The Organizer bears no liability for any damage occurring after prize collection related to the event.

7. Governing Law and Dispute Resolution

7.1 This Agreement shall be governed by, construed, and enforced in accordance with the laws of the State of Texas, USA. Conflict of laws principles of any other jurisdiction shall not apply.

7.2 Any disputes arising from this Event or this Liability Waiver shall be submitted exclusively to the court of the county where the Texas store is located. The participant voluntarily waives the right to file suit in any other jurisdiction or to participate in class action lawsuits.

8. Confirmation of Agreement

By checking “I have agreed to the Liability Waiver & Release of Claims” and submitting your email address, you acknowledge that this constitutes an electronic signature equivalent to a handwritten signature and has the same full legal effect. You declare that you have fully read all terms, had sufficient time to review them, completely understand all the releases and waivers of rights and risks, and voluntarily agree to this Agreement without objection.
